General Terms and Conditions
These General Terms and Conditions of Sale (GTC) govern the online sales of products offered by Superkure via its website www.superkure.fr. By confirming an order on the site, the Customer unreservedly accepts all of the provisions below.
1. Company identification
Seller means the company Superskin, a simplified joint-stock company (SAS) with a share capital of 1,000 euros, registered with the Nice Trade and Companies Register under number 934 870 759, whose registered office is located at 50 Boulevard Stalingrad, 06300 Nice, and identified for VAT under number FR73934870759.
Buyer means any natural or legal person purchasing products via the Site.
Site means the online platform developed by the Seller, accessible at the following address: www.superkure.fr.
2. Products and prices
The products offered are carefully selected dietary supplements designed to contribute to well-being and beauty. Prices are expressed in euros (€) including all taxes (TTC), excluding delivery charges, which are specified at the time of ordering according to the chosen shipping method.
The Seller reserves the right to modify prices at any time. However, the price charged is the one in effect at the time the order is validated, subject to availability.
For any delivery outside of mainland France, customs duties or other local taxes may apply. These charges are the sole responsibility of the Buyer.
The visuals of the products presented on the Site are not contractual and cannot engage the responsibility of the Seller.
3. Order
3.1 Order process
The Customer selects products on the Site and adds them to their shopping cart. The order is validated after entering the necessary information and choosing the delivery method and payment method.
3.2 Confirmation
An order confirmation is sent by email. This constitutes final acceptance of the order by Superkure. In the event that a product is unavailable, the Customer will be informed by email.
3.3 Cancellation
The Customer may cancel an order as long as it has not been shipped. If the order is already being delivered, the Customer should refer to the return policy.
4. Payment
4.1 Terms and Conditions
Payment can be made by credit card (Visa, Mastercard, etc.), via PayPal, or any other method offered on the Site at the time of ordering.
4.2 Security
Payments are secured by advanced encryption protocols. No banking data is stored by Superkure.
5. Delivery
5.1 Delivery methods
Orders are shipped via UPS. Delivery options are offered at the time of ordering. Superkure cannot be held responsible for any consequences related to incorrect information provided by the Customer.
A tracking number is sent by email as soon as the package is shipped.
5.2 Deadlines
Delivery times are indicative and vary depending on the destination.
5.3 Fees
Shipping costs are calculated automatically based on the amount, destination and delivery method.
5.4 Problems
In the event of a delay, damaged, or lost package, the Customer must contact Superkure as soon as possible. In the event of a damaged product, it is imperative to provide photos of the product, packaging, and carrier label, and to retain the package until instructions are returned.
In the event of an error in the address provided by the Customer or prolonged absence upon delivery, resulting in the package being returned to the sender, the reshipping costs will be borne by the Customer.
6. Complaints
The Customer is required to check the condition of the products upon receipt. They have 14 days to report any defects or non-conformities, via the website's contact form or at the following address: contact@superkure.fr, attaching supporting documents (photos, order number, etc.).
After this period and without reservation being issued, the products will be considered as compliant and no complaints will be accepted.
In the event of a proven defect, the Seller undertakes to replace or reimburse the products concerned in accordance with Articles L. 217-4 et seq. of the Consumer Code.
7. Right of withdrawal
7.1 Time limit
In accordance with the law, the Customer has 14 days from receipt to exercise his right of withdrawal, without having to provide a reason for his decision.
7.2 Exercise
The withdrawal request must be sent by email to contact@superkure.fr.
7.3 Return conditions
Products must be returned unopened, in their original condition and packaging. Return shipping costs are the responsibility of the Customer, except in the case of a defective product or Seller error.
In the case of the purchase of a promotional pack or lot (e.g.: pack of 3 products), partial returns of the lot are not accepted.
The Customer must return all products in the package to be eligible for a refund. No partial or pro rata refunds will be issued for incomplete returns.
All returned products will be subject to quality control upon receipt. If the return does not meet the stated conditions, no refund will be issued.
The Customer will be informed by email and may request reshipment of the product at their own expense.
7.4 Exceptions
In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal does not apply to unsealed or perishable products, in particular food supplements.
8. Legal guarantees
In accordance with the legal provisions in force, the products sold on the Site benefit from: – the legal guarantee of conformity provided for by articles L. 217-4 to L. 217-14 of the Consumer Code, – the legal guarantee against hidden defects provided for by articles 1641 to 1649 of the Civil Code.
In the event of non-compliance or defect, the Customer may request a replacement or refund of the product. These guarantees apply independently of any commercial warranty that may be offered.
9. Liability
Superkure cannot be held responsible for incorrect or improper use of its products. Dietary supplements are not a substitute for medical advice or treatment. Customers are encouraged to consult a healthcare professional if in doubt.
10. Intellectual Property
The content of the website www.superkure.fr (texts, images, trademarks, logos, etc.) is protected by intellectual property laws. Any reproduction or use without authorization is strictly prohibited.
11. Personal data
11.1 Collection
The personal data collected is necessary for the management of orders and customer relations.
11.2 Rights
In accordance with GDPR regulations, the Customer has the right to access, rectify, and delete their personal data. All requests should be sent to: contact@superkure.fr
12. Modification of the T&Cs
Superkure reserves the right to modify these Terms and Conditions at any time. The new terms and conditions apply as soon as they are published on the Website. Customers will be informed of the changes via a notice on the Website.
13. Applicable Law and Dispute Resolution
These General Terms and Conditions are governed by French law. In the event of a dispute, the Customer may contact a consumer mediator or refer the matter to the competent courts.
